• Property Condition: You are responsible for maintaining your property in a clean and safe condition.

• Guest Behavior: You agree to take reasonable steps to ensure that your guests comply with applicable laws and regulations and respect your property.

4. Using the Platform

• Respectful Behavior: You agree to use the Platform in a respectful and appropriate manner.

• Prohibited Conduct: You agree not to use the Platform for any illegal or harmful purposes, including harassment, discrimination, or fraud.

• Intellectual Property: You acknowledge and agree that all content on the Platform, including but not limited to text, images, and software, is the property of Swapstay or its licensors.

5. Fees and Payments

• Service Fees: Swapstay may charge service fees for certain services, such as booking fees or support fees.

• Payment Methods: You agree to pay all fees using the payment methods provided on the Platform.

6. Limitation of Liability

To the fullest extent permitted by law, Swapstay shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Platform.  

7. Indemnification

You agree to indemnify and hold harmless Swapstay and its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the Platform or your violation of these Terms.

8. Modification of Terms

Swapstay reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform.  

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany.

10. Dispute Resolution

Any disputes arising out of or in connection with these Terms shall be resolved through arbitration.
